TINJAUAN YURIDIS TERHADAP REGULASI JUAL BELI EMAS ONLINE DALAM PERSPEKTIF HUKUM PERDATA

Abstract

The practice of buying and selling gold online is essentially a form of adaptation of gold trading to the development of digital technology, where the buying and selling process is conducted thru online platforms such ac applications or e-commerce website. Online gold buying and selling transaction have advantages such as ease of access, time efficiency, competitive prices, and the availability of various investment product options. A judicial review of online gold trding regulation from a civil law perspective shows that such transactions are fundamentally valid and legally justifiable as long as they meeetthe valid contract requirements as stipulated in Article 1320 of the Civil Code, namely the agreements of the perties, legal capacity, a specific object, and a lawful cause. This research is normative judicial in nature, with descriptive approach and data collection conducted thru library research and the data obtained are analyzed qualitatively. From the afore mentioned issues, it can be concluded that online gold buying and selling agreements can be conducted to facilitiate soncumers instransaction as long ad the comply with the principles and validity requirements of the agreement
